These Terms and Conditions (“Terms”) govern your access to and use of cuedynamics.com (the “Site”) and your purchase of any Cue Dynamics product or service, including digital products, online courses, and live coaching. By using the Site or completing a purchase, you agree to be bound by these Terms and by our Privacy Policy and Disclaimers, which are incorporated by reference. If you do not agree, do not use the Site or purchase.
Cue Dynamics is a professional education business for Pilates instructors, operated from Toronto, Ontario, Canada. Contact: hello@cuedynamics.com.
Our products and services are intended for certified or in-training Pilates instructors and movement professionals. By purchasing, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and capable of entering a binding contract.
Cue Dynamics offers digital educational products (such as downloadable resources and self-paced courses), live one-to-one coaching sessions, and application-based coaching programs. The specific description, inclusions, duration, and price of each offering are stated on its product page, which forms part of your agreement at the time of purchase. The product-specific terms for each paid offering are reproduced in full in Schedule A at the end of these Terms and are presented again at checkout; they form part of your agreement.
All prices are displayed on the relevant product page or at checkout. Payments are processed securely by Stripe; we do not receive or store your full card details. Prices may change at any time, but changes will not affect purchases already completed. Where a program is described as a single payment, the full amount is due before the program begins.
Applicable taxes, where required by law, are calculated and disclosed at checkout.
Because our products are digital and our coaching is delivered live and personally, the following policy applies:
If something has genuinely gone wrong with your purchase (for example, a technical failure preventing access that we cannot resolve), contact us before initiating any payment dispute and we will work to fix it. Nothing in this section limits any non-waivable rights you have under applicable consumer protection law, including the Ontario Consumer Protection Act.
You agree to contact us to resolve any billing concern before disputing a charge with your card issuer. Chargebacks initiated without first contacting us, where access to the product has been provided as described, may result in suspension of access to all Cue Dynamics products and services.
Access to digital products is delivered electronically after successful payment, to the email address provided at checkout. Access terms specific to a product (such as duration or drip schedule) are stated on its product page. You are responsible for providing an accurate email address and for maintaining the confidentiality of any access credentials.
Live sessions are booked through our scheduling provider and take place online at the scheduled time. You are responsible for attending on time with a working connection. Time lost to late arrival is not added to the session.
All content on the Site and in our products, including course materials, video, audio, text, frameworks, methods, proprietary terminology, workbooks, and visual assets, is the intellectual property of Cue Dynamics and its founder, protected by copyright and other laws. Upon purchase you receive a personal, non-transferable, non-exclusive, revocable licence to access and use the purchased content for your own individual professional development. This licence does not transfer ownership of anything to you.
You agree that you will not, and will not permit anyone else to:
All Cue Dynamics content, materials, courses, and publications are protected works. Translating any Cue Dynamics content into another language, and copying, reproducing, publishing, or distributing any translated version, in whole or in part, is strictly prohibited without the prior written permission of Cue Dynamics. Translation is an exclusive right of the copyright owner under the Copyright Act (Canada) and international copyright treaties, including the Berne Convention, and unauthorized translation or other-language reproduction of Cue Dynamics content constitutes copyright infringement. If unauthorized translation, copying, or distribution is discovered, Cue Dynamics reserves the right to pursue every remedy available at law or in equity, including claims for statutory and other damages and injunctive relief, before the Federal Court of Canada or any other court of competent jurisdiction.
You acknowledge that breach of Sections 11 or 12 would cause us harm that money alone cannot remedy, and that we are entitled to seek injunctive or other equitable relief in addition to any other available remedies.
If you provide feedback or a testimonial, we may use it in our marketing only with your express consent, and we will present it anonymously or with initials unless you expressly agree otherwise. You may withdraw consent for future use at any time by contacting us.
We use third-party providers to operate the business, including Stripe (payments), Acuity Scheduling (booking), Tally (applications and waitlists), and Kit (email). Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
All products and services are professional education for movement instructors. They do not constitute medical, physiotherapy, rehabilitation, legal, financial, or other regulated professional advice, and no professional-client relationship of that kind is created. The Disclaimers page forms part of these Terms.
Physical exercise carries inherent risk. If you perform, demonstrate, or teach any movement referenced in our materials or sessions, you do so voluntarily and at your own risk. You remain solely responsible for your own physical condition, for the safety of your clients, and for practising within the scope of your certification, insurance, and local regulations.
We do not guarantee any particular outcome, including examination results, certification, employment, client numbers, or income. Any results described on the Site, including the founder’s own, are individual experiences and not promises.
The Site and all products and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, Cue Dynamics and its founder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or any product or service. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or any purchase is limited to the amount you paid us for the product or service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Cue Dynamics and its founder from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or third-party right, or your teaching or professional practice.
We may suspend or terminate your access to products or the Site if you materially breach these Terms, including the licence and prohibited-use provisions. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) survive.
These Terms do not exclude, limit, or waive any rights or remedies you may have under applicable consumer protection legislation that cannot lawfully be excluded, limited, or waived, including under the Consumer Protection Act, 2002 (Ontario) where it applies.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Subject to any non-waivable consumer rights, the courts of Ontario have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a reorganization or sale of the business. Neither party is liable for delay or failure caused by events beyond its reasonable control. These Terms, together with the applicable product page, the Privacy Policy, and the Disclaimers, are the entire agreement between you and us regarding their subject matter. Nothing in these Terms creates any partnership, employment, or agency relationship.
We may update these Terms from time to time. The effective date above will be revised when we do. Changes apply prospectively; your continued use of the Site after changes take effect constitutes acceptance.
Each paid offering has its own product-specific terms. They are presented at checkout, where your agreement is recorded before payment, and they are reproduced here in full. Product-specific terms form part of these Terms; if a product-specific term conflicts with a general section above, the product-specific term prevails for that product.
1. What you are buying. A self-paced digital video diagnostic, delivered online.
2. Access. Access is granted to the email address provided at checkout after successful payment.
3. Refunds. All sales are final once access has been granted, subject to any non-waivable rights under applicable consumer law.
4. Licence. You receive a personal, single-user, non-transferable licence for your own professional development. Sharing access with any other person is prohibited.
5. Intellectual property. All content, patterns, frameworks, and materials are the property of Cue Dynamics. You may not copy, record (including with any external device), redistribute, resell, or use them to create competing offerings.
6. Recording. The Audit’s video and materials may not be recorded, captured, or downloaded except where a download is provided. Recording with external devices of any kind (including phones, cameras, and audio or screen capture tools) is not permitted.
7. Educational only. The Audit is professional education for movement instructors, not medical or rehabilitation advice, and no professional advisory relationship is created.
8. Physical activity. Any movement you perform while following the Audit is voluntary and at your own risk.
9. No guaranteed outcome. No specific teaching or professional result is promised.
1. What you are buying. One live, one-to-one coaching session of sixty minutes, delivered online at a time you select after payment.
2. Scheduling. You choose your session time from the calendar on the confirmation page immediately after payment. You are responsible for attending on time with a working connection; time lost to late arrival is not added to the session.
3. Rescheduling. You may reschedule once, with at least 48 hours’ notice, using the scheduling link in your confirmation. Sessions missed without the required notice are forfeited and not refunded.
4. Refunds. All sales are final. This is a booked professional service; no refunds are issued after purchase, subject to any non-waivable rights under applicable consumer law.
5. Preparation. The session works on whichever part of your exam you bring: a sequence, a cue, or the scenario that keeps collapsing. You are responsible for arriving with your breaking point identified.
6. Recording. Sessions are not recorded by either party unless both agree in writing in advance. Recording with external devices of any kind (including phones, cameras, and audio or screen capture tools) is not permitted.
7. Educational only. The session is professional education for movement instructors. It is not medical, physiotherapy, rehabilitation, legal, or financial advice, and no such professional relationship is created.
8. Physical activity. If you choose to perform or demonstrate movement during or after the session, you do so voluntarily and at your own risk, and you remain responsible for your own safety and that of your clients.
9. No guaranteed outcome. No specific examination result or professional outcome is promised.
10. Materials. Any materials shared with you are for your personal professional use only and may not be shared, reproduced, or used to build competing offerings.

2. Access. Access is granted to the email address provided at checkout after successful payment. Access terms specific to the course are stated on the course page.
3. Refunds. All sales are final once access has been granted, subject to any non-waivable rights under applicable consumer law.
4. Licence. You receive a personal, single-user, non-transferable licence for your own professional development. Sharing access or credentials with any other person is prohibited.

7. Independence. The course is built for practical exam preparation generally and is not affiliated with, endorsed by, or an official preparation product of any certifying body. Your certifying body’s own requirements remain your responsibility.
8. Educational only. The course is professional education for movement instructors, not medical or rehabilitation advice.
9. Physical activity. Any movement you perform while following the course is voluntary and at your own risk.
10. No guaranteed outcome. No specific examination score or result is promised.
1. What you are buying. A place in a live, six-week cohort program: thirteen modules released two per week, and three live group calls.
2. Your seat. Places are limited and your seat is personal and non-transferable.
3. Payment. Payment in full reserves your seat and is due before the cohort begins.
4. Refunds. Because seats are limited and reserved for you, the program is non-refundable once the cohort has commenced, subject to any non-waivable rights under applicable consumer law.
5. Live calls. Call times are announced with enrolment. Attendance is your responsibility.
6. Recording. Live calls may not be recorded by participants, and recording with external devices of any kind (including phones, cameras, and audio or screen capture tools) is not permitted. Module content may not be recorded or captured by any means.
7. Module release. Modules unlock on the published schedule relative to the cohort start; the schedule is part of the program design and is not adjusted individually.
8. Licence. Program content is for your personal professional development only. Sharing access, recording, redistributing, or using the material to create competing offerings is prohibited.
9. Community conduct. If the cohort includes group settings, you agree to treat other participants’ information as confidential.
10. Educational only. The program is professional education for movement instructors, not medical or rehabilitation advice; movement you perform is voluntary and at your own risk.
11. No guaranteed outcome. No specific teaching, business, or professional result is promised.
1. What you are buying. A three-month, one-to-one mentorship of six sessions, delivered online, following acceptance of your application.
2. Admission. Places are offered by application and acceptance. This payment completes your acceptance and reserves your place in the cycle. Your place is confirmed only once payment has succeeded; a declined or failed payment does not reserve a place.
3. Payment. The program is a single payment, settled in full before the program begins. There are no payment plans.
4. Refunds. The program is non-refundable once it has commenced, subject to any non-waivable rights under applicable consumer law.
5. Cadence and completion. Sessions run at a cadence of up to two (2) per calendar month, scheduled together, with at least 48 hours’ notice to reschedule. Scheduling sessions outside this 2-per-month cadence requires prior written approval. The program concludes on whichever comes first: completion of all six (6) sessions, or 90 calendar days from purchase (the three-month term). Any sessions not completed by that point are forfeited, and are not refunded, credited, or rescheduled.
6. Confidentiality. What you share in the program is treated as confidential. Any testimonial or reference to your participation is used only with your express consent and presented anonymously or with initials.
7. Recording. Sessions are not recorded by either party unless both agree in writing in advance. Recording with external devices of any kind (including phones, cameras, and audio or screen capture tools) is not permitted.
8. Nature of the work. The mentorship provides career navigation, strategy, and self-advocacy guidance from professional experience. It is not legal, financial, medical, or therapeutic advice. Where a situation calls for a licensed professional, you will be told so.
9. Your responsibility. Decisions about your career, employment, and business remain entirely yours.
10. No guaranteed outcome. No specific career, income, or professional result is promised.
11. Materials. Program materials are for your personal use only and may not be shared, reproduced, or used to build competing offerings.
